Terms of Service
Effective date: October 27, 2026
1. Who we are and what these Terms cover
These Terms of Service (“Terms”) are a binding agreement between you and Whiskrs (“we”, “us” or “our”). We operate Whiskrs, a professional collaboration platform available at whiskrs.app and any related apps, websites and services (together, the “Service” or “Whiskrs”).
By creating an account, or by ticking the box or tapping the button that says you agree, you accept these Terms and the documents they incorporate:
- the Privacy Policy;
- the Community Guidelines;
- the Acceptable Use & Content Policy;
- the Escrow & Deposit Terms (only if and when you use collab payments); and
- any plan, pricing or feature terms shown to you at the point of purchase.
If you do not agree, do not use the Service.
2. What Whiskrs is, and what it is not
2.1 A collaboration platform. Whiskrs helps verified adults who work in adult and adjacent creative industries find and organise lawful professional collaborations: for example photography, modelling, on-camera creator work, styling, makeup, editing, production crew and business partnerships.
2.2 Two sides. Every profile is either a Talent profile (performers, creators and models, called “Talent Members”) or a Producer profile (producers, studios and others who cast for projects, called “Producer Members”). Discovery only happens across the two sides. Talent Members can see Producer profiles but never other Talent profiles.
2.3 Not a dating service. Whiskrs is not a dating, romance, companionship or “meetup” service.
2.4 Not a marketplace for sexual services. You may not use the Service to advertise, offer, request, arrange or pay for sexual services for consideration, in any wording, coded or otherwise. This includes escorting, “private sessions”, “companionship” or “GFE”-type offers, and any in-person or virtual sexual service in exchange for money, goods, travel or anything else of value. This rule applies to profiles, gig posts, intros, applications, chat, media captions, reviews and any off-platform contact that started on the Service. We remove such content and close the accounts involved (see section 11). This rule exists, among other reasons, because Canadian law prohibits knowingly advertising an offer to provide sexual services for consideration (Criminal Code, s. 286.4) and related conduct (ss. 286.1 to 286.3).
2.5 SFW on the platform. The Service is safe-for-work (SFW) on-platform. You may not upload, post or send sexually explicit or nude content anywhere on the Service. See the Acceptable Use & Content Policy.
2.6 We are not a party to your collaborations. We provide tools to find, message, agree and (where offered) pay for collaborations. Unless we expressly say otherwise, we are not an employer, agent, talent agency, producer, broker or party to any agreement between members, and we do not supervise any shoot, set or project. Members are responsible for their own contracts, permits, releases, record-keeping, workplace safety, insurance and taxes.
3. Eligibility
To use the Service you must:
- be at least 18 years old and the age of majority where you live (19 in some provinces, such as British Columbia);
- live in Canada (we are launching in Ontario first). We may block or restrict access from other countries;
- be legally able to enter into a binding contract;
- not have been previously banned from the Service; and
- not be listed on any government sanctions list or be prohibited from receiving services under Canadian law.
You must use the Service only on your own behalf (or, for a Producer profile, on behalf of a business you are authorised to bind). Third-party “managers” or anyone else may not operate a Talent Member’s account.
4. Mandatory identity and age verification
4.1 Required before any social feature. You must complete identity and age verification (government ID plus a selfie or liveness check) before you can use Discover, Meow, intros, chat, gigs, reviews, uploads or payments. Unverified accounts cannot use these features.
4.2 Third-party vendor. Verification is performed by a specialist third-party identity verification vendor. The vendor may use facial comparison technology to match your selfie to your ID. We receive the result (pass or fail), the date, your verified date of birth or an over-18 flag, and a reference ID. See the Privacy Policy for how this information is handled and retained.
4.3 Accuracy. You must provide true, current and complete information, and only your own documents and image. We may ask you to verify again at any time, for example after a report, a change of legal name, a payout request, or if we suspect account sharing.
4.4 One person, one account. One verified person may hold one account. That account may hold one Talent profile and one Producer profile (see section 6). Creating extra accounts, or verifying on someone else’s behalf, is prohibited.
5. Your account
You are responsible for keeping your login credentials secure and for all activity on your account. Tell us immediately at support@whiskrs.app if you think your account has been accessed without permission. We may require multi-factor authentication.
Your public display name does not need to be your legal name. We never show your legal name publicly. You may not impersonate anyone or misrepresent your identity, affiliation, credentials or work history.
6. Dual-role accounts (one Talent profile and one Producer profile)
6.1 Separate profiles. A verified account may add a second profile on the other side. Each profile has its own display name, city, inbox, gigs, reviews, portfolio and (where offered) wallet. One verification covers both.
6.2 Unlinked publicly. We do not publicly link your two profiles, and we design the Service so that other members cannot see that they belong to the same person. You must not take steps that defeat this protection for other members (for example, trying to identify the owner of a profile through the Service).
6.3 Rules that follow the active profile. When acting as Talent, you see only Producer profiles, and Talent Member features are free. When acting as a Producer, you see only Talent profiles, and Producer plan limits and fees apply.
6.4 Account-wide enforcement. Blocks, suspensions and bans apply to the whole account, including both profiles. A block made from either of your profiles covers your whole account, and blocking either profile of another member blocks that whole person.
7. How matching, intros and messaging work
- Meow. A “Meow” is the Service’s “interested in working with you” signal. Meows are free and unlimited. When both members Meow at each other (“mutual Meow”), chat opens.
- Producer intros. Producer Members may send an intro message to a Talent Member without a mutual Meow, subject to plan limits. Talent Members may accept (chat opens) or decline (the intro is removed). Declining is always free and needs no reason. To keep inboxes free of spam, every plan (including Pro) is subject to automated fair-use safety limits on how many intros can be sent in a short period. If you reach one, you can send more intros later.
- Talent Members cannot send cold messages to Producers. They can message after a mutual Meow or by accepting an intro.
- No plan bypasses consent. Paid plans increase limits but never remove a member’s ability to decline, mute, block or report.
- Gig board. Producer Members may post gigs for lawful SFW-described professional work, and verified Talent Members may apply. Gig posts must follow the Community Guidelines. Talent Members cannot see other applicants.
- Boundaries & rates. Talent Members may optionally list boundaries (Yes / No / Message me to ask) and booking rates for filming and content work. Only ID-verified Producer Members who can see the profile can view them. Before sending an intro or accepting an applicant, a Producer must confirm that the production fits the Talent Member’s boundaries; the Service will not send an intro or accept an applicant where the production includes something marked “No”. A listed boundary or rate is not consent to any booking and is not an offer capable of acceptance: every collab is agreed separately, in writing, and consent can be withdrawn at any time, including on set. Rates are for professional work (time, deliverables, usage, licensing) and never for sexual services (section 2.4).
- Reviews. After a collab is marked complete, both sides may leave a double-blind review. Reviews stay sealed until both submit or 14 days pass. Reviews must be honest, relevant and SFW.
8. Plans, pricing and billing
8.1 Talent Members are free. Talent Members never pay a subscription or any fee for Talent Member features, now or in future. If we ever introduce optional paid extras for Talent Members, they will be optional, we will give you clear notice, and the core Talent Member features will stay free.
8.2 Producer plans.
| Plan | Price (CAD) | Includes (summary) |
|---|---|---|
| Free | $0 | 3 intros per calendar month (unused intros do not roll over) and 1 open gig at a time |
| Pro (monthly) | $19.99 per month | Unlimited intros (subject to fair use and our anti-spam rules), unlimited open gigs, featured gig boost, “who viewed my gig” insights |
| Pro (yearly) | $199.99 per year | Same as Pro monthly, billed once a year |
Prices are in Canadian dollars and exclude applicable GST/HST/QST, which are added at checkout where they apply. Plan details shown at checkout form part of these Terms.
8.3 Payment processor. Subscription payments are processed by our third-party payment processor (for example CCBill or Segpay). The processor’s name and the descriptor that will appear on your card statement are shown at checkout. We do not receive or store your full card number. The processor’s own terms also apply.
8.4 Automatic renewal. Pro plans renew automatically at the end of each billing period at the then-current price until you cancel. For yearly plans we will email you a reminder at least 30 days before renewal. We will give you at least 30 days’ notice of any price increase, and you may cancel before it takes effect.
8.5 Cancelling. You can cancel at any time in You → Plan, with no need to contact support. Cancellation takes effect at the end of the current billing period, and you keep Pro features until then.
8.6 Refunds. Refunds and cancellations are covered by our Refund & Cancellation Policy, which forms part of these Terms. Nothing in these Terms limits any refund or cancellation right you have under consumer-protection law in your province.
8.7 Collab payments (escrow and deposits). If and when we offer collab payments, they are governed by the separate Escrow & Deposit Terms. Until then, any payment between members happens off the Service, at the members’ own risk and responsibility.
9. Your content
9.1 You own your content. “Your Content” means anything you post or send: profile text, portfolio links, photos, videos, gig posts, applications, messages, reviews and reports. You keep ownership of Your Content.
9.2 Licence to us. You grant us a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers only) licence to host, store, copy, process, display, scan, moderate and transmit Your Content only as needed to operate, secure, moderate and improve the Service and to comply with law. We will not use your photos or videos in advertising or marketing without your separate, express consent. The licence ends when Your Content is deleted from the Service, except for copies we must keep under section 12 or our Privacy Policy (for example, content preserved because of a report or legal obligation).
9.3 Your promises. You confirm that:
- you own Your Content or have every right needed to post it;
- every person who appears in any photo or video you upload is at least 18, is you or a verified member who has approved the upload, or has given you documented written consent to that specific use (and you will provide that consent to us on request);
- Your Content is SFW and follows the Acceptable Use & Content Policy; and
- Your Content does not infringe anyone’s copyright, trademark, privacy, publicity or other rights.
9.4 Moderation before publication. Uploaded photos and videos are scanned automatically and may be reviewed by a person before they appear on your profile. We may decline, remove, blur or restrict any content that we believe breaks these Terms or our policies, or that creates legal or safety risk.
9.5 Copyright complaints. If you believe content on the Service infringes your copyright, contact legal@whiskrs.app with the details listed in our Acceptable Use & Content Policy. We may remove the content and, for repeat infringers, close accounts.
10. Rules of conduct
You must follow the Community Guidelines and the Acceptable Use & Content Policy. In summary, you must not:
- advertise, offer, request or arrange sexual services for consideration, escorting or “meetups” (section 2.4);
- post or send nudity or sexually explicit content;
- involve, depict, contact or discuss anyone under 18 in any sexualised way, or attempt to use the Service if you are under 18;
- harass, threaten, pressure, coerce, stalk, dox or “out” anyone;
- pressure anyone to change or make an exception to a boundary, or offer extra payment for something they have said no to;
- impersonate anyone or use someone else’s ID, photos or identity;
- pressure anyone to pay, or be paid, off the Service to avoid our safety and payment tools, or run scams, phishing or fake gigs;
- engage in or facilitate human trafficking, exploitation, or control of another person’s account or earnings;
- share another member’s private information, or content from chats, outside the Service without consent;
- scrape, reverse-engineer, overload, probe or interfere with the Service, or use bots or automation; or
- break any law.
11. Reports, enforcement and appeals
11.1 Reporting. You can report a profile, gig, message, review or media item from the “…” menu, and block or mute anyone at any time. Reports marked as a safety concern are prioritised.
11.2 What we may do. If we believe you broke these Terms or our policies, or that action is needed to protect members, the public or the Service, we may: remove content; issue a warning; limit features (for example, intros, gigs or uploads); pause payouts or collab payments as described in the Escrow & Deposit Terms; suspend your account; or permanently ban you and your account. Automated signals (for example, an unusually high share of declined intros, or blocks and reports from several members) may flag an account for review by a person. A flag on its own never leads to a suspension or ban. The usual enforcement ladder is described in the Community Guidelines, but we may skip steps for serious violations, such as any involvement of minors, sexual services for consideration, trafficking, threats of violence, non-consensual intimate images or fraud.
11.2A Temporary restriction during an urgent review. If a verified member in good standing reports your account for a suspected minor, intimate or private material shared without consent, or threats or violence, we may automatically place your account under temporary review while a moderator checks the report. During the review your profiles are hidden, and you cannot send Meows, intros or messages, upload media, or post or apply to gigs; you can still read your existing chats, change settings, block or report others and download your data. A temporary review is a safety precaution, not a finding that you did anything wrong, and we will not tell you who made the report. A person reviews every case, and we aim to finish within 24 hours. We then either lift the restriction, restoring your account in full, or take action under 11.2, which you may appeal under 11.4. Safeguards against misuse (such as limits on how many accounts one member can affect) are described in the Community Guidelines.
11.3 Reports to authorities. We report suspected child sexual abuse or exploitation material as required by Canadian law (including to the Canadian Centre for Child Protection / Cybertip.ca) and may report other suspected crimes, or threats to anyone’s safety, to police. We preserve data where required by law.
11.4 Appeals. If we remove your content or restrict or close your account, we will tell you (unless the law or a safety concern prevents it) and you may appeal within 30 days at appeals@whiskrs.app or the in-app appeal form. A different person from the original reviewer will consider the appeal. We aim to respond within 10 business days.
11.5 Automated decisions. Some moderation steps use automated tools (for example, image classifiers and text pattern detection). You may ask for a human to review any decision made solely by automated means. See the Privacy Policy. A temporary review under 11.2A is always followed by a review by a person.
12. Ending your account
You may delete your account at any time in You → Settings → Account. If you have a Pro plan, cancel it first (deleting your account will cancel renewal). If you have funds held in a collab payment, deletion will wait until the collab is settled.
When an account is deleted or closed, we delete or anonymise your information as described in the Privacy Policy, except information we must keep for legal, safety, tax, fraud-prevention, dispute or enforcement reasons (for example, records of a ban so you cannot rejoin, and records of reports involving you).
We may suspend or end the Service, or any feature, with reasonable notice where possible. If we end a paid feature you have prepaid for, we will refund the unused portion.
13. Safety: please read
- Verification confirms that a member passed an ID and age check at a point in time. It is not a background check, a criminal-record check or an endorsement, and it does not guarantee anyone’s conduct.
- Agree scope, boundaries, pay and logistics in writing before any collab. Meet first in public or at a known professional location. Tell someone where you are going.
- You can withdraw from any collab at any time. Consent can be withdrawn. No one is entitled to anything because of a Meow, an intro, a match, a review or a payment.
- If you are in immediate danger, call 911.
14. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we do not guarantee that the Service will be uninterrupted or error-free, that you will find collaborators or work, or that any member’s profile, portfolio, reviews or statements are accurate. We are not responsible for members’ conduct on or off the Service.
Nothing in these Terms excludes any warranty or condition that cannot be excluded under applicable consumer-protection law, including the Ontario Consumer Protection Act, 2002 and the Quebec Consumer Protection Act.
15. Limitation of liability
To the extent permitted by law, we (and our directors, officers, employees and contractors) are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or opportunities, arising out of or relating to the Service or any collaboration between members. To the extent permitted by law, our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) CAD $100.
These limits do not apply to liability that cannot be limited by law, including where consumer-protection law in your province prevents it, or for our fraud, gross negligence or wilful misconduct.
16. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims, losses and reasonable legal costs arising from Your Content, your collaborations, or your breach of these Terms or the law. This section does not apply to consumers where prohibited by law.
17. Disputes, governing law and venue
17.1 Talk to us first. Most concerns can be resolved quickly. Contact support@whiskrs.app and we will try to resolve the issue within 30 days.
17.2 Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. If you are a consumer, you keep the protection of any mandatory laws of your province of residence.
17.3 Courts. Subject to section 17.4, the courts of Toronto, Ontario have exclusive jurisdiction, except that consumers may bring claims in the courts of their province of residence where the law allows.
17.4 Arbitration and class actions. Nothing in these Terms requires a consumer to arbitrate a dispute or waives any right a consumer has to take part in a class action where the law gives that right.
18. Changes to these Terms
We may update these Terms. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, explain the change, and (for paid plans) let you cancel without penalty. Continued use after the effective date means you accept the updated Terms.
19. General
- Entire agreement. These Terms and the incorporated documents are the entire agreement between you and us about the Service.
- Severability. If any part is found unenforceable, the rest stays in effect.
- No waiver. Not enforcing a right is not a waiver of it.
- Assignment. You may not transfer your account or these Terms. We may assign these Terms in connection with a merger, acquisition or sale of assets, with notice to you.
- Language. Les parties ont exigé que la présente convention et tous les documents connexes soient rédigés en anglais. A French version of these Terms will be provided before the Service is offered to consumers in Quebec.
- Notices. We may send notices to the email on your account or in the app. You may send notices to legal@whiskrs.app.
